In Madrid, just like throughout Spain, buying, selling, transporting, and publicly using cocaine are all strictly against the law. Under Spanish law, cocaine is regarded as a substance that poses serious health risks, with different penalties applied depending on whether possession is seen as personal use or as intent to traffic.

Penalties

• Personal Possession & public Consumption: Possession of cocaine is prohibited but not considered a criminal offence. Nevertheless, possessing or consuming it in public spaces—such as streets, bars, or parks—constitutes a serious administrative offense. This leads to the immediate confiscation of the substance by police, along with fines between €601 and €30,000 for first-time or repeat offenses.
• Trafficking: Cocaine possession, sale or distribution of quantities exceeding personal use is considered a criminal offence. A conviction for trafficking cocaine results in a prison sentence of 3 to 6 years, along with significant financial penalties that can reach up to three times the value of the seized drug. If organized crime or aggravating circumstances are involved, the penalties rise considerably, reaching up to 9 to 12 years or more.

Instead of dedicated “open-air vendor markets” for cocaine, drug activity in and around Madrid is concentrated in busy nightlife areas, transit hubs, and particular municipal districts that face regular police surveillance and anti-trafficking operations.
